Tailored debt collection for entrepreneurs

Tailored debt collection

Every claim is different — we tailor the approach to your situation, your debtor, and your interests

Do you have a complex claim where standard no-cure-no-pay collection is insufficient? MKBjuristen reviews your file and proposes a tailored approach — from extrajudicial demand to provisional attachment and bankruptcy petition. Fixed price, single point of contact.

  • Prevent your evidentiary position from weakening
  • Clarity regarding reminding, admonishing, or summoning
  • Advice on disputed invoices and dissatisfied customers
  • Assistance with negotiation or proceedings if necessary
First, determine the position. We look at agreements, evidence, and risks.
Do not escalate unnecessarily. The right tone often prevents further conflict.
Practical next step: You know whether sending a formal demand letter, negotiating, or litigating makes sense.

Sound familiar?

Do you recognize any of these situations? Then tailored debt collection is probably the right choice.

Your claim exceeds €25,000

Standard no-cure-no-pay debt collection has an upper limit. For larger claims, we discuss a customized approach and costs.

The debtor raises a substantive defense

The customer disputes the invoice, files a counterclaim, or engages a lawyer themselves. This requires a legal approach, not a standard demand letter.

You want to take other steps in addition to debt collection

Preservative attachment, summary proceedings, bankruptcy application, or dissolution of the agreement — we coordinate the entire process.

There are multiple debtors or related parties

The situation is more complex than a single invoice and a single debtor. We map out the relationships and determine the strongest course of action.

You wish to recover damages in addition to the claim

In addition to the outstanding invoice, you have also suffered consequential damage. We will assess whether and how that damage can be recovered.

Please note: waiting too long or responding incorrectly can work against you later. Therefore, first document what has been agreed upon, delivered, and communicated.

What is tailored debt collection?

Not every claim is the same. An unpaid invoice of €3,000 where the customer does not respond requires a different approach than a claim of €18,000 where the customer raises a substantive defense. Nor does it involve rent arrears where eviction is also at issue. Or a claim against a debtor who is at risk of bankruptcy and where provisional attachment is necessary.

Tailored debt collection means that we assess each claim individually and adapt the approach to your specific situation: the amount of the claim, the debtor's attitude, the available evidence,
the urgency, and your commercial interests.

When is tailored debt collection the right choice?

Standard no-cure-no-pay debt collection works excellently for undisputed B2B business claims between €1,500 and
€25,000. However, there are situations where a standard approach is insufficient.

Tailored debt collection is advisable for larger claims exceeding €25,000 where the approach and strategy require more customization. It is also appropriate for claims where the debtor disputes the invoice on its merits, files a counterclaim, or mounts a legal defense. Furthermore, it applies to situations where other legal steps are necessary in addition to collection—such as provisional attachment, summary proceedings, a bankruptcy petition, or dissolution of the agreement.

Additionally, in rent collection involving eviction proceedings, in claims involving multiple debtors, or in business disputes where damages must be recovered in addition to the claim.

Our approach: from assessment to result

We always start with a substantive assessment of your file. We review the agreement, invoices, terms and conditions, and correspondence — and provide honest advice regarding the chances, costs, and the
most sensible course of action.

Next, we determine the approach together. This could be:

An out-of-court process via a demand letter and negotiation — in many cases the fastest and cheapest route, even for larger claims.

A legal process in which we engage a specialized lawyer for a summons, provisional attachment, or bankruptcy application.

A combined process in which we take simultaneous extrajudicial and judicial action — for example, a demand letter combined with provisional attachment in the event of indications of asset flight.

Or a negotiation process in which we negotiate a settlement, payment arrangement, or settlement agreement on your behalf.

What does customized debt collection cost?

The costs depend on the route that is most sensible for your situation. We are transparent about the costs before we start.

For undisputed claims up to €25,000, we work on a no cure no pay basis. For larger claims or more complex processes, we discuss a fixed price or a combination of a fixed price and a success fee in advance. Legal costs, such as court fees and bailiff's costs, are in most cases recovered from the losing party.

No hidden costs, no hourly rate surprises. You know exactly what to expect upfront.

One point of contact from start to finish

At MKBjuristen, you remain with a single point of contact throughout the entire process. We initiate the out-of-court process ourselves and, where necessary, immediately engage a specialized lawyer — without you having to switch firms, without transfer losses, and without your file needing to be explained again.

How do we help?

We do not initiate litigation. First, we map out your legal position, evidence, and commercial interests. Then, we determine the appropriate step for the problem.

1

Review file

We review the agreement, invoices, general terms and conditions, correspondence, and any defense — and provide honest advice regarding chances, costs, and the most sensible course of action.

2

Determine a tailored approach

We determine the strategy together with you: out-of-court, judicial, combined, or negotiation. You know the cost in advance.

3

Take action

We initiate the process — demand letter, negotiation, provisional attachment, or proceedings — and immediately engage a lawyer where necessary.

4

Payment or next step

We monitor the process from start to finish and advise on next steps if payment is not received.

Frequently Asked Questions

What is the difference between standard debt collection and customized debt collection?

Standard no-cure-no-pay debt collection works excellently for undisputed business claims up to €25,000. Tailored collection is for situations where standard collection is insufficient: larger claims, disputed invoices, multiple debtors, combinations with attachment or bankruptcy proceedings, or cases where damages also need to be recovered. We assess which approach suits your situation.

What does customized debt collection cost?

The costs depend on the most sensible approach for your situation. For undisputed claims up to €25,000, we work on a no cure no pay basis. For larger claims or more complex processes, we discuss a fixed price or a combination of a fixed price and a success fee in advance. In most cases, legal costs are recovered from the losing party. You always know exactly where you stand beforehand.

Do I need to switch contact persons if my case becomes more complex?

No. At MKBjuristen, you remain with a single point of contact throughout the entire process. We initiate the out-of-court process ourselves and, where necessary, immediately engage a specialized lawyer — without transfer and without your case being explained again.

Can I recover damages in addition to debt collection?

Yes. If, in addition to the outstanding invoice, you have also suffered consequential damage — lost revenue, extra costs for a replacement supplier, damage claims from your own customers — we will assess whether and how that damage can be recovered. This is included in the process.

What if the debtor offers no recourse?

We first conduct an asset tracing investigation if there is reason to do so. Litigating against a debtor who offers no assets to recover is costly and pointless. If the investigation reveals that recovery is unlikely, we honestly advise you not to initiate proceedings. This saves you costs and time.

Do you also handle claims exceeding €25,000?

Yes. For claims exceeding €25,000, we discuss the approach and costs on a case-by-case basis. The no cure no pay structure does not apply to these claims, but we work as much as possible with fixed prices and a clear cost estimate in advance.

Tailored debt collection always begins with an honest assessment. Not every claim requires the same approach — and not every approach is commercially sound. We assess this as the first step, always.

NB

  • Always have your file reviewed first before choosing a route
  • Combine extrajudicial and judicial action in response to signs of asset flight
  • Conduct a recovery investigation if you are unsure whether litigation is worthwhile
  • Always record agreements regarding the approach and costs in writing
  • The sooner you act, the more legal routes remain available
