Non-contractual liability (tort)
Non-contractual liability is liability arising from a tort. For non-contractual liability, no agreement is required between the parties. There is no agreement between two parties, yet one party suffers damage due to the conduct of the other. The injured party can then file a tort claim with the court. A tort exists when an infringement is made on someone else's right.
Whoever commits a wrongful act against another is obliged to compensate the injured party for the damage. The legal framework sets five requirements for a wrongful act:

- Injury
- Causality
- Relativity requirement
