If a debtor fails to adhere to a payment arrangement, you may terminate it and demand payment of the full outstanding debt in one lump sum — provided you have properly documented this in advance and notify the termination in writing. A payment arrangement gives the debtor breathing room and you a structured way to still get paid, but it stands or falls with clear conditions regarding what happens if a payment is missed. Below, you can read how to arrange this.

What is a payment arrangement?

A payment arrangement is an agreement between creditor and debtor whereby a debt is not settled all at once, but in installments . It offers the debtor a breathing space and provides you, as the creditor, with an orderly route to still collect the amount owed. It is therefore often a better outcome than immediate litigation — provided the agreements are clearly documented.

When can you terminate a payment arrangement?

A payment arrangement may end prematurely for various reasons:

  • The debtor pays the remainder in a lump sum — the arrangement is then simply concluded.
  • The debtor fails to meet the deadlines — in practice, the most common reason.

The key is to arrange this in the original agreement. For example, agree that the arrangement automatically terminates as soon as one installment is not paid (on time), after which the entire outstanding balance becomes immediately due and payable. Such a forfeiture clause prevents disputes and strengthens your position.

How do you terminate the arrangement correctly?

Formal termination generally requires written notification to the debtor. That letter:

  • makes clear that the scheme is being discontinued;
  • states the reason (for example, a missed deadline) and refers to the original agreements;
  • demands the remainder of the debt in one lump sum;
  • Indicates what further steps you will take if payment is not received.

A legally correct letter is important: it protects your position and forms the basis for potential debt collection.

What are the consequences of termination?

As soon as the arrangement ends, the entire remaining debt becomes immediately due and payable. This may lead to further collection measures or legal proceedings. Moreover, for the debtor, it means that additional costs may be incurred, such as interest and collection fees. In the event of continued non-payment, filing for bankruptcy be an option.

Frequently asked questions about payment arrangements

Do I have to agree if a debtor proposes a settlement?

No, you are not obliged. A proposal is, however, a good sign — it shows that the debtor wants to do something about the unpaid invoices . However, do not simply agree to it: have the proposal reviewed first, so that the terms (and the forfeiture clause) protect your interests.

May I charge interest and costs during a payment arrangement?

That depends on the agreements and, for consumers, on the statutory rules regarding interest and collection costs. Clearly record whether and which interest and costs apply, so that no disputes arise regarding this later.

Does a payment arrangement interrupt the statute of limitations on my claim?

An admission of the debt — for example, by reaching a settlement — can interrupt the statute of limitations, causing a new period to start. Nevertheless, caution is advised: if in doubt, have your claim and the moments of interruption checked to prevent the statute of limitations from expiring.
