When and how do you determine whether a DPIA is required?

These questions determine whether and how you conduct a DPIA.

Do you process special or criminal data on a large scale? In that case, a DPIA is in principle mandatory (Articles 9 and 10 GDPR).
Do you engage in profiling with consequences for people? A systematic automated assessment with legal effect requires a DPIA.

Do you have a Data Protection Officer? Involve them in the DPIA and document the advice.

How do you use a DPIA correctly?

A DPIA only works if you carry it out carefully and in advance. Please note the following.

Drafting a DPIA (Data Protection Impact Assessment), why?

Not every entrepreneur knows exactly what DPIA (Data Protection Impact Assessment) is, when you need it, and which risks it must cover. That is why we explain below what this document entails, what you should look out for, and why customized legal solutions are important.

What is a DPIA?

A DPIA (Data Protection Impact Assessment) is a tool used to identify privacy risks and determine appropriate measures before starting data processing. The GDPR mandates a DPIA when processing is likely to pose a high risk to data subjects (Article 35 GDPR).

When is a DPIA mandatory?

A DPIA is mandatory in any case for large-scale processing of special categories of personal data (Article 9 GDPR) or criminal data, for systematic large-scale monitoring of public spaces, and for systematic and extensive automated assessment (profiling) with legal consequences. European supervisory authorities apply nine criteria; if your processing meets two of these, a DPIA is generally required.

What is included in a DPIA?

A DPIA contains at least a systematic description of the processing and the purposes, an assessment of the necessity and proportionality, an assessment of the risks to the rights and freedoms of data subjects, and the measures to mitigate those risks (Article 35(7) GDPR).

High residual risk: consult the Dutch Data Protection Authority

If the DPIA shows that a high risk remains even after measures have been taken, you must consult the Data Protection Authority before processing (Article 36 GDPR). A good DPIA prevents you from discovering too late that a processing operation is unacceptable.

A DPIA does not stand alone. The outcomes have an impact on your processing register, your data processing agreements , and your privacy statement. Keep the DPIA up to date: if the processing changes, you must reassess it.
