What elements belong in a privacy statement?

Articles 13 and 14 of the GDPR prescribe exactly what information you must provide to data subjects. The following elements therefore belong in virtually every privacy statement.

Use in practice

How do you use this document correctly?

A privacy statement is not a one-off document. It must remain consistent with your practice and be accessible to data subjects.

Upon publication Place the statement in an easily findable location on your website and with every form where you request data. Article 13 of the GDPR requires you to inform at the time of collection.
With new processing Amend the statement before you start processing a new purpose or new data. The information must be up-to-date and complete; reporting afterwards is too late.
When engaging a processor Conclude a data processing agreement and name the recipient in the statement. The statement and your contractual agreements must align.
Periodically Check at least annually whether the statement still corresponds to reality. Outdated information creates a false sense of security and is itself an offense.

Most problems do not arise from the absence of a statement, but from a statement that does not match practice. Watch out for these errors.

Fail to state basis or state incorrectly The processing lacks a valid basis and becomes unlawful. Link each purpose to a legal basis from Article 6 of the GDPR.
Never update statement The text lags behind new processing and becomes unlawful itself. Schedule a periodic check and update with every change.
Confusing a privacy statement with a data processing agreement You do inform data subjects, but do not record agreements with processors. In addition, use a data processing agreement for each engaged processor.

What is a privacy statement?
A privacy statement is the public-friendly term for the privacy declaration with which an organization explains on its website, in its app, or in its communications how it processes personal data. In practice, the term privacy statement is used interchangeably with privacy policy and privacy declaration — legally, there are no substantial differences. Pursuant to Articles 13 and 14 of the GDPR, every controller is obliged to inform data subjects about the processing of their personal data. The privacy statement is the most commonly used method to comply with this transparency obligation in a manner accessible to the general public. What are the legal requirements for a privacy statement?
