What is an internal privacy statement for employees?
An internal privacy statement for employees is the document by which an employer informs its employees about the processing of their personal data within the context of the employment relationship. Pursuant to Articles 13 and 14 of the GDPR, every employer has a duty of transparency towards its employees: the employee must know which personal data is being processed, for what purpose, on what legal basis, how long the data is retained, who has access, and what rights the employee has. The internal privacy statement is not the same as the external privacy statement on the website — which is aimed at customers and website visitors. The internal version focuses exclusively on the personal data processed within the context of the employment relationship: payroll administration, personnel files, sickness absence, monitoring, performance reviews, and exit procedures. Which processing activities must the internal privacy statement describe?
A comprehensive internal privacy statement for employees describes the following elements for each processing activity. The purposes: payroll administration, tax returns, access management, personnel development, sickness absence management, monitoring of ICT usage. The legal basis for each processing activity: performance of the employment contract, statutory obligation (payroll taxes, reporting sick), legitimate interest (monitoring, fraud investigation). The retention periods: salary data seven years pursuant to Article 52 of the Dutch General Tax Act (AWR), personnel file two years after termination of employment, sickness data limited in accordance with the Dutch Sickness Benefits Act (WVP). The recipients: payroll processor, occupational health service, pension fund, UWV. And the rights of the employee: access, correction, deletion, objection, and complaint to the Dutch Data Protection Authority (AP).
