The right to rectification gives individuals the right to have inaccurate personal data corrected or incomplete data completed (Article 16 GDPR). As an organization, you must ensure that the data you process is accurate and execute a legitimate rectification request in a timely manner.
What is the right to rectification?
Under the GDPR, a person can ask you to correct their personal data if it is inaccurate, or to complete it if it is incomplete (Article 16 GDPR). Such a request often comes after the data subject has seen, via a request for access, which data you process about them. The right to rectification stems from your duty to process accurate data.
Your duty: correct data
The GDPR requires that personal data be accurate and, where necessary, updated. If you work with outdated or incorrect data, this can harm the data subject — for example, in the case of an incorrect address, a wrong name, or an error in a file. Therefore, keep your data up-to-date and correct.
How do you process a request?
If you receive a request for rectification, assess whether the data is actually incorrect or incomplete. If so, correct or supplement it, in principle within the statutory period (usually one month, with a possible extension). If you have shared the data with others, you must in principle also inform them of the rectification.
You do not have to follow every request
You are only required to rectify what is demonstrably incorrect or incomplete. If it concerns an opinion, an assessment, or data that is correct, you do not need to adjust them simply because the person concerned disagrees. Document your assessment and the handling of the matter.
