What is R&D (Research and Development)?

RVO defines R&D as new technical development, aimed at software, technical products, processes, or physical events. Two categories:

  • Development work: new products, production processes, software.
  • Technical-scientific research: without a direct commercial purpose.

What does NOT qualify: market research, training, standard software development without technical novelty, copy-pasting of existing solutions, quality control, production.

WBSO tax credit on R&D wage costs
  • Standard: 32% on the first €350,000 of R&D wage costs, 16% on amounts exceeding that.
  • Startup rate (first 3 years of business, no more than 5 man-years of R&D): 40% on the first €350,000.
  • Self-employed entrepreneurs: fixed amount R&D deduction (€14,046 in 2024, plus €7,023 start-up bonus for the first 3 years).

Calculation of wage cost basis: gross R&D wage × 1.3 (rounding factor for overhead). Discount is settled via payroll tax return — direct liquidity.

How do you apply for WBSO?

Application to RVO via eHerkenning:

  1. Project description: technical problem statement, chosen approach, novelty compared to existing knowledge.
  2. Estimate of R&D hours per employee.
  3. Period: maximum 1 year per application, submit at least 1 month before start.
  4. Decision within 4-6 weeks — WBSO statement issued.
  5. Monthly payroll tax return offsets the discount.
  6. Annually: report realization (R&D hours actually worked).

What do you need to document?

Tracking during the year:

  • Time recording per employee per R&D project (hours per day/week).
  • Progress reports: what has been resolved, what needs to be investigated.
  • Result documentation: prototypes, code versions, test results.

The RVO conducts retroactive sample checks — insufficient documentation can lead to recovery.

WBSO and innovation box

A WBSO declaration is a sufficient basis for the Innovation Box (9% corporate income tax rate on innovative profit). For R&D-intensive startups: WBSO + Innovation Box together often result in an additional saving of one thousand to ten thousand euros per employee per year.
