The Healthcare Quality, Complaints and Disputes Act (Wkkgz) imposes obligations on healthcare institutions and independent healthcare professionals regarding the safeguarding of care quality. The Wkkgz includes the possibility for a client/patient to file a complaint against a healthcare institution or independent healthcare professional (also known as a healthcare provider). After the complaint is filed, it will first be determined whether consultation between the parties leads to a solution. The complaint will be handled by an independent complaints officer appointed at the expense of the healthcare provider. An attempt is made to reach a joint solution. If the parties do not reach a joint solution, a complaint may be submitted to a dispute resolution body. It is also possible for the patient to claim compensation. The dispute resolution body will issue a ruling in the form of a binding opinion.
Under the Wkkgz (Dutch Healthcare Quality Act), a healthcare provider must comply with a number of obligations to prevent complaints as much as possible. First, a healthcare provider has a duty of verification. This means that healthcare providers must verify the employment history of employees. This includes checking for the presence of a Certificate of Conduct (VOG), as well as a check in the BIG register or warning register. In addition to the duty of verification, the healthcare provider has a reporting obligation. This entails that a report must be made in cases of, among other things, violence in the care relationship, termination of the employment contract due to poor performance, and other calamities in the care sector. The healthcare provider is required to make this report under penalty of an administrative fine.
