Not every entrepreneur knows exactly what drafting an invoice entails, when they are needed, and which risks they must cover. That is why we explain below what this document involves, what to look out for, and why customized legal solutions are important.

What requirements must an invoice meet?

A legally and fiscally correct invoice contains a number of mandatory details: a sequential unique invoice number, the invoice date, your name, address and VAT identification number, the name and address of your customer, a clear description and quantity of the goods or services supplied, the date of delivery, the amount excluding VAT per rate, the applicable VAT rate, and the VAT amount. If these details are missing, your customer cannot deduct the VAT and you run the risk of being audited.

The mandatory invoice details at a glance

The VAT invoice requirements are derived from the law. Below, you will see what must be included for each section and where things go wrong in practice. Additional disclosures apply to special situations — reverse charge VAT, supplies within the EU, or the small business scheme.

Invoice numbering and VAT

Invoice numbers must be sequential and unique; each number may appear only once. If you provide VAT-taxable services, state the rate and the VAT amount. In the case of reverse charge VAT or an exemption, include the correct statement instead of a VAT amount.

How long must you keep invoices?

You must retain invoices in their original form for seven years; for data concerning real estate, a retention period of ten years applies. Digital storage is permitted, provided that the representation is accurate and complete and the invoice remains authentic.
