When is a fixed-term collaboration?

A fixed-term partnership is suitable if you wish to work temporarily with one or more parties: for the execution of a specific project, the temporary provision of a service, or as a trial period prior to a potential long-term collaboration. The temporary nature provides both parties with flexibility.

Termination by operation of law

In principle, a fixed-term agreement ends automatically on the end date or upon reaching the agreed end goal (such as the completion of a project). Termination is then not necessary. Clearly define the end date or the end criterion to avoid any disputes regarding when the collaboration ends.

Extension and early termination

Stipulate whether and how the collaboration can be extended; tacit renewal applies only if you agree to it. Also include a provision for early termination: is this possible, on what grounds (such as breach of contract), and with what consequences? Without such a provision, you may be bound until the end date, even if you are dissatisfied with the collaboration.

What else do you need to arrange?
