If you sell books, you are not free to determine the price. The Fixed Book Price Act requires you to apply the fixed price set by the publisher for Dutch and Frisian-language books. This also applies online and via sales platforms. Only limited discounts are permitted.
The fixed book price
Pursuant to the Fixed Book Price Act, the publisher or importer sets a fixed price for a new Dutch-language (and Frisian-language) book. Every seller—shop, webshop, or seller via a platform—must apply that price. Therefore, you may not offer a book at a lower price (or a higher price) to lure customers.
Why a fixed price?
The fixed book price protects the broad and varied book selection and the position of (smaller) bookstores. Without a fixed price, large players could dominate the market with bargain prices, at the expense of diversity. The law ensures a level playing field.
Which discounts are allowed?
The law permits only limited exceptions and discounts, for example for certain customers or under specific conditions. Outside of those exceptions, you must maintain the fixed price. After a certain period, the fixed price may expire, after which you are free to set your own prices.
Be careful with online and platform sales
Even if you sell books online or via a platform such as a large web store, the fixed book price applies. Therefore, do not assume that you are free to undercut prices online. Adhere to the rules to avoid problems.
