With a webshop, you automatically process customers' personal data and must therefore comply with the GDPR. Pay particular attention to: a clear privacy statement, a valid legal basis, good security, correct cookie consent, and data processing agreements with your suppliers.

You process personal data

Names, addresses, email addresses, telephone numbers, and order details are personal data. If you store these in a customer database or use them for marketing, the GDPR applies and obligations apply.

Inform your customers

You have an obligation to provide information: in a clear privacy statement, you explain which data you process, for what purpose, on what legal basis, and how long you retain it. The statement must be easy to find on your webshop.

Basis, security and retention period

You need a legal basis for every processing activity (Article 6 GDPR); the execution of the purchase covers a lot, but marketing often requires separate consent. Secure the data appropriately and do not retain it longer than necessary.

Cookies and processors

You require valid consent for tracking and marketing cookies. If you engage parties that process data on your behalf — for example, for hosting, payment, or shipping — you must enter into a data processing agreement with them (Article 28 GDPR).

Frequently Asked Questions

May I use customer data for marketing?

You usually need separate permission for this; the legal basis for the purchase does not automatically cover marketing.

Do I need a data processing agreement?

Yes, with parties that process personal data on your behalf, such as your hosting, payment, or shipping partner (Article 28 GDPR).

How long am I allowed to retain customer data?

No longer than necessary for the purpose; statutory time limits apply to some data, such as your records.
