If the tenant of your business premises dies, the lease agreement does not terminate automatically: in principle, the rights and obligations pass to the heirs who accept the estate. What happens to the property thereafter depends on their choice and on your lease agreement.

The lease agreement does not terminate due to the death

The death of the tenant does not terminate the lease by operation of law. If the heirs accept the inheritance, they assume the rights and obligations under the lease agreement and must continue to pay the rent. In the case of multiple heirs, this applies in proportion to their share.

Heirs can accept an inheritance unconditionally, accept it conditionally (beneficiary acceptance), or reject it. If all heirs reject the inheritance, a special situation arises in which an executor often becomes involved.
