Copyright can also protect quotes and one-liners, but only if they are original enough: the text must have its own personal character. Short, everyday sentences are usually too banal for protection — but a creative slogan can be.

When is something protected by copyright?

For copyright protection, a work must have a distinct, original character and bear the personal stamp of the creator. This applies to drawings and music, but in principle also to language. The form counts, not the idea behind it.

Quotes and one-liners: often too short

We have the feeling that language belongs to everyone, and for very short sentences, that is often legally true. An everyday or obvious sentence usually lacks the required originality and is therefore not protected. The shorter and more ordinary, the smaller the chance of protection.

When is there protection?

A creative, distinctive slogan or one-liner with its own personal character can indeed be protected by copyright. Additionally, under certain circumstances, a catchy slogan can be registered as a trademark or protected under trademark law. Whether protection exists depends on the specific text.

What does this mean for your business?

If you use someone else's slogan, do not assume that it is available. And if you want to protect your own slogan, consider trademark registration in addition to copyright. In case of doubt, a legal assessment is advisable.

Frequently Asked Questions

May I freely use a famous quote?

Short, everyday sentences are often not protected. But a distinctive, creative slogan can be; do not simply assume that something is available.

Can I have my slogan protected?

A creative slogan can be protected by copyright, and you can often also register it as a trademark for stronger protection.

What determines whether a text is protected?

Originality: does the text have its own personal character? The shorter and more ordinary, the smaller the chance.
