A copyright contract establishes how a creator—such as an author, illustrator, or musician—makes their work available to another party and which rights are transferred in the process. It protects both the creator and the user by clearly regulating what may be done with the work, for how long, and for what remuneration.

What is a copyright contract?

Creative works — texts, illustrations, photographs, music, software — are valuable intellectual property. If the creator makes their work available to a third party, a copyright contract specifies what use is permitted and how the rights are handled. In this way, both parties avoid ambiguity and conflicts.

License or transfer?

The core issue is whether the creator licenses or transfers their rights. With a license, the user receives permission to use the work within certain limits; the creator remains the rights holder. With a transfer, the rights themselves are transferred, for which a deed is required. Document exactly what has been agreed upon — and how broadly.

What else do you need to arrange?

A good copyright contract regulates, among other things: for what use and through which channels the work may be deployed, the territory and duration, whether adaptation is permitted, whether it is exclusive, and the remuneration (for example, a one-off payment or royalty). Attribution and confidentiality may also be included.

Protection under the Copyright Contracts Act

If a creator enters into an agreement with a party that exploits their work, the Copyright Contracts Act offers additional protection: the right to fair remuneration, supplementary compensation in the event of unexpected success, and the recovery of rights in the event of insufficient use. A good copyright contract takes this into account.
