A training agreement formalizes the arrangements between a trainer and their client — whether for a personal trainer or for training a horse or dog. It is a form of contract for services; documenting it in writing prevents disputes regarding objectives, price, and liability.

What is a training agreement?

In a training agreement, a person has themselves, another person, or an animal trained by a (personal) trainer. Examples include a personal trainer guiding a client, or a dog trainer or jockey training an animal. In all cases, the trainer performs a service, and there is a contract for services.

What do you record in it?

Clearly define the core elements: the goal of the training, the number of sessions, the duration and schedule, the price and payment, and the cancellation policy. For animals, it is advisable to also specify the expected result, the method, and who is responsible for their care.

Note liability

Training involves risks: a client may get injured or an animal may cause damage. Therefore, clearly define who is liable for what, within legal limits, and refer to your general terms and conditions. A trainer can limit their liability, but not without limit — certainly not towards consumers.

Obligation of effort or obligation of result?

Usually, a trainer promises an effort, not a guaranteed result. Make this explicit so that a client cannot wrongfully demand a specific end result. Clear wording prevents disappointment and claims.

Frequently Asked Questions

Do I need a written contract as a personal trainer?

Highly recommended. A written training agreement sets out the objective, price, schedule, and liability, and prevents disputes.

Am I promising a result or an effort?

Usually requires effort. Document this explicitly so that a client cannot demand a guaranteed end result.

Can I limit my liability?

Within limits, yes, via your terms and conditions. Restrictions apply to consumers; complete exclusion is not possible.
