Good rental terms describe the entire duration of the lease: from commencement and handover to payment, maintenance, and termination. The components below form the basis. Exactly which ones you need depends on what you are renting out and to whom.

How do you use this document correctly?

Rental conditions are only effective if they have been made known to the tenant at the right time and demonstrably accepted. Follow the steps below.

Most problems when renting do not arise from the rent itself, but from careless or missing agreements. Avoid the mistakes below.

Drafting rental terms, why?

Not every entrepreneur knows exactly what lease terms are, when they are needed, and which risks they must cover. That is why we explain below what this document entails, what to look out for, and why customized legal solutions are important.

What are rental conditions?
Rental terms and conditions are the general terms and conditions applied by a landlord when renting out spaces, vehicles, equipment, inventory, or other objects. They establish the generic conditions that apply to all rental agreements concluded by the landlord: the payment schedule, the condition at the start and upon return, liability for damage or loss, maintenance and insurance, the termination policy, and the consequences of non-payment. Rental terms and conditions are the mirror image of the individual rental agreement: the individual agreement regulates the customized arrangements—who, what, when, and for what price—while the general rental terms and conditions regulate the standard conditions that apply to all rental relationships. In professional rental practice, well-drafted rental terms and conditions are essential for resolving disputes regarding damage, termination, and deposits based on pre-agreed rules. How do you regulate the condition at the start and return in the rental conditions?
The condition at the start and return is the most conflict-prone provision in tenancy agreements. Without an inspection report at the start, it is impossible to determine at the end of the tenancy which damage already existed at the start and which was caused by the tenant. Your tenancy terms must require an inspection report at the start of the tenancy, preferably with photos attached. At the end of the tenancy, it is determined on the basis of that same report which damage is the responsibility of the tenant. Normal wear and tear — signs of use inherent to normal use — is the responsibility of the landlord; unauthorized damage or excessive wear caused by careless use is the responsibility of the tenant. Our lawyers formulate an inspection and handover procedure that prevents disputes afterwards.
How do you arrange liability for damage to and loss of the rented object?
The renter is liable for damage resulting from use contrary to the rental conditions or from careless use, but not for normal wear and tear. Your rental conditions must specify the liability arrangement per type of damage. For vehicles: the renter is liable for damage to or loss of the vehicle during the rental period, unless the damage is the result of a defect that already existed at the start of the rental. For inventory and equipment: the renter is liable for damage, loss, or theft during the rental period. Your rental conditions must also specify the insurance arrangement: is the lessor insured for damage to the rented object and, if so, how is the deductible distributed, or is the renter required to take out their own insurance? Our lawyers draft a liability structure that adequately protects the lessor.
What are the special rules regarding rental conditions for consumer leases?
When renting to consumers, additional protection rules apply pursuant to Section 6.5.3 of the Dutch Civil Code (unfair terms) and, in the case of short-term rental of movable property, the rules for consumer credit apply if hire-purchase elements are present. Clauses in rental conditions that exclude the lessor's liability for death or injury, or that prevent the consumer from invoking their statutory rights, are void. Clauses that unreasonably increase the burden of proof for the consumer are voidable pursuant to the black and grey lists of Articles 6:236 and 6:237 of the Dutch Civil Code. Your rental conditions for consumers must be written in an understandable manner — the transparency requirement — and not be unreasonably burdensome. How do you regulate termination and the end of the lease in the lease terms?
The termination clause in your lease terms must align with the type of rental. For short-term rentals of movable property—from one day to a few weeks—no notice period is customary, but the procedure for return must be clearly established. For long-term rentals of inventory or equipment, a notice period applies that suits the nature of the relationship—typically one to three months. Your lease terms must also specify the procedure for late return : a penalty clause per day of delay that compensates the landlord for the loss of income for the next tenant.
