What is a quitclaim for portrait rights?
A portrait rights quitclaim — also known as a model release, portrait rights consent, or portrait rights consent statement — is the document by which a depicted person grants permission to a photographer, filmmaker, or publisher to use, publish, and exploit his or her portrait. Pursuant to Article 21 of the Copyright Act, the depicted person has the right to object to the disclosure of his or her portrait if he or she has a reasonable interest that is harmed by the publication. The quitclaim is the contractual counterpart: by signing, the depicted person waives his or her right to object to the described use. Without a valid quitclaim, a photographer, advertiser, or media company risks a claim for portrait rights infringement.
