Which elements belong in a minimum-maximum employment contract?

A minimum-maximum employment contract is an on-call agreement and must therefore contain a number of specific provisions in addition to the standard terms and conditions of employment. The components below ensure that the agreements are legally sound and workable.

Drafting a minimum-maximum employment contract, why?

Not every entrepreneur knows exactly what minimum-maximum employment contracts are, when they are needed, and which risks they must cover. That is why we explain below what this document entails, what to look out for, and why customized legal solutions are important.

What is a minimum-maximum employment contract?
A min-max employment contract is an employment agreement in which the employer guarantees an employee a minimum and maximum working hours per week or per month. The employee is entitled to payment for at least the number of hours stipulated as the minimum, and the employer has the right to call upon the employee for a maximum of the established maximum. The min-max contract gives the employer more flexibility than a contract with fixed working hours, but offers the employee more security than a zero-hours contract. The min-max contract is regulated in Article 7:628a of the Dutch Civil Code (BW), which contains the on-call contract rules. Our lawyers will draft a min-max employment contract for you that complies with the on-call contract rules of Article 7:628a BW, correctly establishes the notice period, and anticipates the Flexible Labour Admission Act effective from 2026.
What legal rules apply to minimum-maximum contracts?
Pursuant to Article 7:628a of the Dutch on-call contracts —including min-max contracts—are subject to a number of mandatory rules. The employer must call up the employee at least four days in advance . If the call is made less than four days in advance, the employee is not obliged to come to work. After twelve months, the employer must make the employee an offer for a fixed working time equal to the average number of hours worked during those twelve months. If the employer refuses to make this offer, the employee is entitled to wages based on the average number of hours. The employer must observe the call-up period annually, even in the case of tacit renewal. Your min-max contract must correctly stipulate the call-up period and the obligation to offer a fixed working time. Our lawyers draft an on-call contract that meets all legal requirements.
How do you prepare your min-max contract for the Flexible Work Admission Act?
The Flexible Labour Admission Act — passed by the House of Representatives and intended to take effect in 2026 — imposes additional restrictions on the use of on-call workers and min-max employees. The law limits the possibility of making long-term use of on-call contracts and requires employers to offer fixed working hours after a certain period. Your min-max contracts must be revised in light of the new law. Our lawyers keep your flex contracts up to date and advise you on the transitional arrangements.
