What is an AI policy for staff?
An AI policy for employees is the internal company document that establishes the rules for the use of AI tools by employees in the course of their work. Examples include the use of ChatGPT, Microsoft Copilot, Google Gemini, Claude, and other generative AI tools for drafting texts, analyzing data, writing code, or summarizing documents. The AI ​​policy is the employer's translation of the AI ​​Act, the GDPR, and company-specific risks into concrete rules of conduct for employees: what is permitted use, what is prohibited, which data may be entered into AI tools and which may not, and how is AI output vetted before it is used externally? Which AI Act obligations already apply to your organization?
The EU AI Act — effective as of 2 August 2026 for most provisions — imposes obligations on providers and users of AI systems. For organisations deploying AI tools, the obligations regarding high-risk AI systems relevant: if your organisation uses AI for personnel decisions — recruitment, assessment, promotion — or for decisions concerning customers that have legal consequences, additional transparency and oversight requirements apply. Your AI policy must inform employees about the AI ​​systems the organisation deploys, the categories of use, the obligation for human oversight regarding AI-assisted decisions, and the procedure for reporting AI-related incidents. Which personal data are employees not allowed to enter into AI tools?
This is the most urgent GDPR question regarding the use of AI in the workplace. If an employee enters customer data, personnel information, medical data, or other personal data into an external AI tool — ChatGPT, a SaaS application with AI functionality — that tool processes the personal data on behalf of the organization. This is only lawful if the organization has entered into a data processing agreement with the AI ​​tool provider or if the processing is otherwise legally valid. Without that legal basis, entering personal data into external AI tools is a GDPR violation. Your AI policy must explicitly state which categories of data may not be entered into external AI tools — personal data, trade secrets, confidential customer information — and which AI tools are approved for business use. How do you address the copyright risks associated with AI-generated output?
AI-generated texts, images, code, and other content raise copyright questions. In the Netherlands and the EU, there is currently no copyright on works generated entirely by AI without substantial human creative contribution — the work has no creator within the meaning of the Copyright Act. This means that, in principle, your competitors are free to copy and use the AI-generated output of your employees. Conversely, AI-generated output can infringe the copyright of the model's training data. Your AI policy must inform employees about the copyright status of AI output, the obligation to check AI usage for plagiarism, and the procedure for validating AI-generated content before it is published externally or delivered to clients. Is an AI policy subject to Works Council consent?
An AI policy that establishes rules regarding the monitoring of employees' AI usage or the processing of employees' personal data by AI applications is subject to the Works Council's consent requirement pursuant to Article 27, paragraph 1, subsections k and l of the Works Councils Act (WOR). An AI policy that determines how AI is used in personnel decisions—evaluation, selection, task allocation—is also subject to the consent requirement. The consent process must be completed before the AI ​​policy is implemented.
