How do you use this document correctly?

A disclaimer only protects you if the reader can reasonably know it. Therefore, ensure visibility and consistency.

Not every entrepreneur knows exactly what disclaimers are, when they are needed, and which risks they must cover. Therefore, we explain below what this document entails, what to look out for, and why customized legal solutions are important.

What is a disclaimer?
A disclaimer is the statement by which a website owner, publisher, or service provider limits or excludes liability for the content of their website, publications, or services. The disclaimer informs visitors or users about the limitations of the information provided, the exclusions of liability for damages resulting from the use of that information, and the intellectual property rights to the content. In Dutch legal practice, the disclaimer is considered a special contractual document: it is only effective if the visitor has been able to take notice of it and the content does not violate mandatory law. A disclaimer is not a miracle cure — the publisher remains liable for incorrect, misleading, or harmful information, even if a disclaimer has been posted — but a correctly drafted disclaimer does indeed offer legal protection against user claims. What are the limits of a disclaimer?
A disclaimer cannot exclude liability without limitation. The legal limits are as follows. Liability for intent or gross negligence can never be contractually excluded — a disclaimer attempting to do so is void pursuant to Article 6:232 read together with Article 6:236 of the Dutch Civil Code. Liability for death or injury can never be excluded towards consumers pursuant to Article 6:236 sub f of the Dutch Civil Code. A disclaimer referring to factually incorrect information while the publisher knew the information was incorrect offers no protection against a tort claim pursuant to Article 6:162 of the Dutch Civil Code. Disclaimers from professional service providers — lawyers, accountants, medical professionals — are assessed cautiously by judges: the professional standard of due care cannot be disclaimed away. What are the essential components of a website disclaimer?
A complete website disclaimer contains at least the following elements. A limitation of liability for content: the information on the website is for general information purposes only and cannot be considered professional advice; the website owner is not liable for damages arising from the use of or reliance on the information. A disclaimer of accuracy: although the information has been compiled with care, the owner does not guarantee its completeness, accuracy, or currency. An intellectual property clause: all content — texts, images, logos — is protected by copyright and may not be reproduced without permission. A link disclaimer: the website owner is not responsible for the content of external websites linked to. And a disclaimer of modification: the owner reserves the right to modify the content of the website and the disclaimer. How does a disclaimer differ from a privacy statement and a cookie statement?
These three documents are sometimes confused or combined, but each has its own legal function. The disclaimer governs liability for the content of the website and the information provided. The privacy statement informs visitors about how their personal data is processed — this is a legal obligation under Article 13 of the GDPR that cannot be included in a disclaimer. The cookie statement informs about the cookies that are placed and is an obligation under the Telecommunications Act. All three documents are individually mandatory and must be published separately and accessible on your website. A combined document that attempts to fulfill all three functions is legally acceptable provided that all legally required information is fully included. When is a disclaimer of particular importance?
A disclaimer is particularly relevant in the following situations. Websites financial, legal, or medical advice : the disclaimer must explicitly state that the information is not a substitute for professional advice and that the user should consult a professional for specific questions. Websites with user-generated content: the website owner must explicitly state that they are not responsible for user-posted content and offer a complaint mechanism. Websites news or current information : a disclaimer regarding the timeliness and accuracy of the information is essential. And corporate websites with international visitors: a disclaimer regarding applicable law and the competent court is useful if the website also targets non-Dutch visitors.
