Not every entrepreneur knows exactly what car lease regulations are, when they are needed, and which risks they must cover. That is why we explain below what this document entails, what you should look out for, and why customized legal solutions are important.

What is a car lease regulation?
A car lease policy — also known as a car policy or driver's policy — is the internal company document in which an employer sets out the conditions under which employees may use a lease car or company car. The car lease policy regulates who is entitled to a lease car, which categories apply to which positions, how the personal contribution is arranged, who bears which costs, how damage and traffic fines are handled, and what happens to the car when the employee leaves the company. The car lease policy is part of the terms of employment and is therefore legally binding if it is correctly incorporated into the employment contract or terms of employment policy. Without a proper car lease policy, disputes arise with every employee change, every instance of damage, and every reorganization that could easily have been prevented. Is a lease car a condition of employment, and what does that mean for modification or withdrawal?
This is the most practically urgent question for employers wishing to revise their lease policy. A lease car that is structurally made available to an employee by virtue of their position or employment qualifies as a secondary employment benefit. The Amsterdam Court of Appeal has confirmed this principle. This means that you cannot unilaterally withdraw a lease car without a compelling business interest that outweighs the employee's interest. In principle, you are obliged to offer compensatory compensation upon withdrawal. This also applies if you switch from a fossil fuel lease to an electric car or a mobility budget: the change in the employment benefit requires either the employee's consent or a valid ground for unilateral modification. Your car lease regulations must contain a right of unilateral modification that meets the requirements of Article 7:613 of the Dutch Civil Code. How do you handle the taxable benefit and personal contribution in the car lease regulations?
The tax addition is the tax regulation whereby the list price of the lease car is added annually at a certain percentage to the employee's gross salary, on which payroll taxes are withheld. As of 2026, a tax addition percentage of 22% of the list price applies to all cars — including electric ones. Your car lease regulations must clearly stipulate who bears the tax burden of the tax addition: the employer via a net salary reduction, or the employee via a gross personal contribution. An personal contribution is tax-deductible from the tax addition, but only if that contribution is actually charged and paid. Your regulations must also specify the procedure for the Declaration of No Private Use: if an employee does not use the car privately and can demonstrate this via a complete mileage log, they are not required to pay the tax addition. What changes regarding the pseudo-final levy on fossil fuel lease cars as of 2027?
As of January 1, 2027, the government is introducing a pseudo-final levy of 12% for employers who allow employees to use fossil fuel lease cars—petrol, diesel, or hybrid—for private purposes, including commuting. This is a levy for the employer in addition to regular payroll taxes. The levy does not apply to fully electric cars. Lease cars made available to an employee for the first time before January 1, 2027, are exempt from the pseudo-final levy until September 17, 2030. This offers employers a limited time window to make their fleet more sustainable. The tax impact on employers with large fossil fuel fleets is significant. Your car lease regulations must anticipate the pseudo-final levy by including a clause giving the employer the right to adjust the lease car category to comply with tax and environmental regulations. How do you handle damage, traffic fines, and parking costs in the car lease regulations?
The allocation of costs for damage and fines is one of the most common sources of conflict in car leasing practice. Your car lease regulations must clearly stipulate, by category, who bears which costs. Damage: most lease cars are insured with comprehensive coverage, but the insurance deductible can be recovered from the employee if the damage is due to their fault. The maximum deductible arrangement must be reasonable and is not recoverable without limit. Traffic fines: in principle, the employee bears the fines resulting from their driving behavior. The employer is obliged to inform the registered owner of the license plate who the actual driver was. If they fail to do so, the fine may be imposed on the employer. Your regulations must stipulate the employee's obligation to respond to license plate letters in a timely manner. Parking and toll costs for business use are generally borne by the employer; private parking costs are borne by the employee. How do you arrange the lease car upon termination of employment, long-term illness, and suspension?
The lease car upon termination of employment: the car lease regulations must specify when the lease car must be returned — usually on the last working day — and who bears the costs for any early termination of the lease contract if the employee leaves before the end of the lease term. This represents a significant financial risk if the leasing company charges a termination fee. In the event of long-term illness: the employee is, in principle, entitled to the lease car as a condition of employment, even during illness. Temporary withdrawal is possible if the employee demonstrably does not use the car, but requires a valid reason and compensation. In the event of suspension or placing on inactive status: the employee retains their terms of employment, including the lease car, in principle, unless a right of recovery upon suspension is included in the employment contract or regulations.
