Drafting camera surveillance regulations, why?

Not every entrepreneur knows exactly what camera surveillance regulations entail, when they are needed, and which risks they must cover. Therefore, we explain below what this document contains, what you should look out for, and why customized legal solutions are important.

What is a camera surveillance regulation?
Camera surveillance regulations are the internal policy document that establishes the rules for the use of camera surveillance at the work location, in stores, parking lots, or other areas managed by the organization. Camera surveillance involves the processing of personal data and falls entirely under the GDPR. The Dutch Data Protection Authority imposes strict requirements on the lawfulness of camera surveillance: there must be a legitimate purpose, the surveillance must be necessary and proportionate to the purpose, data subjects must be informed, and images may not be retained longer than necessary. Furthermore, at the workplace, the Works Council (OR) consent requirement under Article 27, paragraph 1, subparagraph l of the Works Councils Act (WOR) applies to regulations concerning the monitoring of the presence and conduct of employees. What legal basis applies to camera surveillance and how do you justify it?
The most commonly used legal basis for camera surveillance is the legitimate interest of the controller pursuant to Article 6(1)(f) of the GDPR: security of property, prevention of theft or vandalism, or the safety of employees and visitors. The legitimate interest must be concretely substantiated in the regulations: what specific security risk justifies the camera at *this* location? A camera intended solely to monitor employees' work performance has a weaker legal basis than a camera aimed at a cash drawer or a storage location. Particular point of attention: covert camera surveillance of employees is only permitted in the event of a concrete suspicion of criminal behavior, for a limited period, and after consultation with the Works Council. What retention periods apply to camera footage?
Camera footage may not be retained for longer than necessary for the purpose of the camera surveillance. The Dutch Data Protection Authority uses a maximum retention period of four weeks for regular camera surveillance. Footage used as evidence in an incident — theft, vandalism, labor dispute — may be retained for longer as long as it is necessary for that purpose, but must be deleted thereafter. Your regulations must specify the retention periods per camera or location, describe the procedure for extension in the event of incidents, and assign responsibility for timely deletion.
