Not every entrepreneur knows exactly what car schemes are, when they are needed, and which risks they must cover. That is why we explain below what this document entails, what to look out for, and why customized legal solutions are important.

What is a car scheme?
A car policy is an employer's internal policy document that establishes the general framework for the use of company cars by employees. It is the overarching policy document under which individual driver agreements are concluded. The car policy determines who is entitled to a company car, which car category applies per job level, the maximum list price per class, the permitted and prohibited forms of use, the allocation of costs between employer and employee, and the sanctions policy for violations of the usage rules. The car policy is the foundation of a consistent, verifiable, and fiscally responsible fleet. Employers without a car policy operate on the basis of ad-hoc agreements that are open for discussion again during every employee meeting or conflict. What is the difference between a car policy and a car lease regulation?
In practice, these terms are used interchangeably, but there is a functional distinction. The car policy is the overarching policy document that establishes the organization-wide framework for fleet allocation and use — who gets which car, under which general terms and conditions. The car lease regulations are the more detailed regulations governing the specific conditions for lease cars, including taxable benefit, personal contribution, claims settlement, and the return procedure. Many organizations combine both documents into a single set of regulations. The legal consequences are the same: both documents are part of the employment relationship if they are incorporated into the employment contract or employment conditions regulations, and neither can be unilaterally amended without further ado if they qualify as terms of employment. Which positions or levels entitle you to a company car?
The allocation criteria for a company car must be objectively and transparently defined in the car policy to prevent discrimination complaints and arbitrariness. The most commonly used criteria are job level and salary scale, business driving needs expressed as a minimum number of business kilometers per year, the employee's region or location, and the representativeness requirements of the position. Your car policy must clearly define which employees receive a company car based on business necessity — where the taxable benefit and fiscal burdens differ from those for a car provided primarily as a benefit of employment — and which employees receive a car as a secondary benefit of employment, independent of business driving needs. This distinction is fiscally relevant: for cars used primarily for business purposes where the employee drives less than 500 kilometers privately, the taxable benefit is waived upon a complete mileage log. How do you arrange the private use of the company car?
The private use of a company car is the core of the tax addition scheme. If an employee uses the car for private purposes as well—including commuting—the addition must be added to their salary. If the employee wishes to avoid paying this addition, they must be able to demonstrate, with a comprehensive mileage log, that they have driven less than 500 private kilometers per year. Your car policy must determine whether private use is permitted, under what conditions, and how the addition and any personal contribution are arranged. A particular point of attention: taking the car abroad for a private holiday is generally considered private use. Your car policy must also determine whether the employee may take the car on foreign holidays and whether additional insurance coverage is required for this. How do you handle damage, traffic fines, and liability under the car policy?
In practice, the allocation of liability and costs in the event of damage is the most conflict-prone provision of the company car policy. Regarding damage to the company car, the policy typically distinguishes three situations: damage caused by the employee to the company car itself, damage caused by the employee to third parties, and damage caused by third parties to the company car. In the case of damage to the car caused by the employee, the employer can only recover the damages from the employee pursuant to Article 7:661 of the Dutch Civil Code if there is intent or conscious recklessness. A standard arrangement in which all damage is borne by the employee is not enforceable under employment law. Your company car policy can, however, stipulate a reasonable deductible amount. Regarding traffic fines: the employee is responsible for fines incurred as a driver. Your company car policy establishes the reporting and repayment obligations. How do you prepare your car policy for the 2025–2028 tax changes?
The coming years will bring far-reaching tax changes for the vehicle fleet. The reduced addition percentage for electric cars is being phased out: 17% in 2025, 18% in 2026, 20% in 2027, and 22% in 2028 — equal to that of fossil fuel cars. The 60-month rule retains the lower percentage for five years after initial registration: an electric car registered in 2025 or 2026 will still benefit from the lower rate until 2030 or 2031, respectively. As of 2027, the government is introducing a pseudo-final levy of 12% for employers on fossil fuel lease cars used for private use and commuting. Your car policy must contain a clause giving the employer the right to adjust the fleet to changed tax regulations, with a transparent procedure for employees. How do you arrange the transition to a mobility budget in the car scheme?
More and more employers are considering the switch from a fixed lease car to a mobility budget, allowing employees to choose how to spend their budget—car, public transport, bicycle, shared car, or a combination. As of January 1, 2020, the Tax Qualification Policy for Legal Forms of Employment Relationships Act was introduced, which facilitates the mobility budget. Converting a lease car to a mobility budget is a change in terms of employment that requires the employee's consent if the lease car qualifies as a secondary employment benefit. Your car policy must establish the procedure for a potential transition and define the framework for the mobility budget. Our lawyers advise you on the legal feasibility of a transition to a mobility budget and draft the corresponding policy.
