Custom choices

Which choices determine the content?

The right privacy policy depends on how your organization handles data. Answer the questions below before finalizing the text.

Choice or question Why this matters legally
What data do you collect and why? Map out all your processing activities; the policy must align exactly with your actual practice, not with a general example.
On what basis do you process? Consent requires an active act; a contract or legitimate interest imposes different requirements on substantiation.
Do you share data with third parties or outside the EEA? This determines whether you must designate processors, sub-processors, and transfer safeguards.
Do you target consumers, businesses, or both? The tone and duty to provide information differ; for consumers, a higher threshold of comprehensibility applies.
Do you process special or sensitive data? Health, biometric, or criminal data call for a stricter regime and additional safeguards.
Clauses and provisions

What elements belong in a privacy policy?

The GDPR prescribes what information you must provide to data subjects. The components below together form a complete privacy policy. Exactly which ones apply depends on your processing activities.

Provision Relevant to Legal point of attention
Identity of the controller Always Name, location details, and contact details of your organization, so that stakeholders know who is responsible.
Purposes and basis Always For each processing activity, describe the purpose and the legal basis (consent, contract, statutory obligation, legitimate interest).
Categories of personal data Always Which data you process, such as name, email address, IP address, or payment details.
Retention periods Always How long you retain data or what criteria you apply for doing so.
Recipients and transmission When sharing with third parties To which processors or parties you provide data and whether transfer takes place outside the EEA.
Rights of data subjects Always Right of access, rectification, erasure, restriction, objection and data portability, plus how to exercise them.
Right to complain and contact Always Possibility to lodge a complaint with the Dutch Data Protection Authority and your contact details or those of the Data Protection Officer.
Cookies and tracking When using website trackers Reference to or inclusion of a cookie statement with the cookies used and their purpose.
Use in practice

How do you use this document correctly?

A privacy policy is not a one-off document. With the steps below, you keep the statement accurate and findable.

Situation What should you do? Point of attention
Upon commissioning Place the policy in a fixed, findable location on your website and refer to it in forms. The GDPR requires that data subjects be informed in advance and simply.
During data collection Refer to the relevant passage at the time of collection. Information must be provided at the time you obtain the data.
In the event of changes to processing Update the policy immediately when you add new data, goals, or parties. The statement must always correspond to actual practice.
Periodically Check at least annually whether the content is still correct. Legal requirements and business processes change; outdated texts increase the risk.
Common mistakes

Common mistakes

Privacy policies often go wrong on points that later lead to complaints or enforcement. Watch out for the following pitfalls.

Wrong Consequence Better approach
Copying a standard text from the internet The statement does not align with your actual processing and is therefore misleading. Tailor the policy based on your own processing activities.
Do not specify legal basis per processing You cannot substantiate your processing during an audit or complaint. Link an explicit GDPR legal basis to each processing activity.
Omit retention periods or keep them vague The parties involved cannot assess their rights, and you are violating the duty to inform. State concrete timeframes or clear criteria.
Concealing processors and transfer Required safeguards and information are lacking when sharing data outside the EEA. Name the recipients and the safeguards taken.
Never update the policy The text is becoming outdated and does not cover new adaptations. Schedule periodic maintenance and adjust immediately upon changes.
Risk profile

What is your situation and what do you pay attention to?

The points of attention vary by type of organization and processing. Do you recognize your situation below?

Risk profile Example Focus in the document
Webshop or online service You process customer, order, and payment data and frequently use tracking cookies. Align with your cookie statement and name payment service providers as recipients.
Employer You process personnel data from application to termination. Distinguish an internal privacy statement for employees from the external policy.
SaaS or software company You are often a processor for your customers and the data controller for your own data. Clarify the role in which you are acting and attach a data processing agreement.
International service provider You share data with parties outside the EEA. Establish the basis for transfer and safeguards, such as standard contractual clauses.
Additional documents

When is this document not enough?

A privacy policy informs data subjects but does not cover all privacy agreements. You will need additional documents in the following situations.

Situation Supplementary document Why
Situation Related document Explanation
You allow another party to process data Data Processing Agreement When engaging a processor, you are required to record the agreements in a data processing agreement.
You share confidential information with a partner Confidentiality Agreement A confidentiality agreement is appropriate for protecting trade secrets and confidential data.
You work structurally with another company Cooperation Agreement In the case of joint processing or data sharing, you define the roles and responsibilities in a cooperation agreement.
Explanation of this document

Drafting a privacy policy, why?

Not every entrepreneur knows exactly what privacy policies are, when they are needed, and which risks they must cover. That is why we explain below what this document entails, what to look out for, and why customized legal solutions are important.

What is a privacy policy?
A privacy policy is the document by which an organization explains to its users, customers, employees, or visitors how it handles personal data. Pursuant to Articles 13 and 14 of the GDPR, every controller has a duty of transparency: data subjects must be informed about which personal data are processed, for what purpose, on what legal basis, how long they are retained, who has access, and what rights data subjects have. The privacy policy—also known as a privacy statement, privacy policy, or privacy declaration—is the instrument used to fulfill this duty of transparency. A missing or incomplete privacy policy can lead to fines from the Dutch Data Protection Authority of up to four percent of global annual turnover or twenty million euros. Our lawyers draft a privacy policy for your organization that fully complies with Articles 13 and 14 of the GDPR, correctly describes all processing activities, and aligns with your processing register and cookie statement.
What information must a privacy policy contain under the GDPR?
Article 13 of the GDPR stipulates that a privacy policy regarding direct data collection must contain at least the following information: The identity of the controller: name, address, contact details. The contact details of the Data Protection Officer (DPO), if one has been appointed. The purposes and legal basis of the processing: for each purpose, the specific legal basis — consent, contract, statutory obligation, or legitimate interest. The categories of personal data. The recipients or categories of recipients. The retention periods. The rights of data subjects: access, rectification, erasure, objection, restriction, portability. The right to lodge a complaint with the Data Protection Authority. And information regarding transfers outside the EEA, if applicable. Our lawyers draft a privacy policy that correctly and comprehensibly integrates all GDPR requirements.
How do you keep your privacy policy up to date?
A privacy policy that is complete upon drafting but is not maintained offers no protection. You are required to update your privacy policy if processing activities change — new services, new suppliers, new purposes — and if legislation or case law changes. Your privacy policy must state the date of the last update and maintain a version history. Our lawyers advise you on a management process for your privacy policy that ensures updating and guarantees alignment with your processing register.
How does it work at MKBjuristen?
After a brief intake, our lawyers draft a privacy policy that fully complies with Articles 13 and 14 of the GDPR, correctly describes all processing activities, and aligns with your processing register and cookie statement.
Are you unsure whether your document is legally correct? We would be happy to assess the sensible course of action: drafting, reviewing, or amending.

Why not use a standard document?

A standard document often seems like a quick solution, but usually does not fully align with your company, agreements, risks, and way of working. Our legal experts draft documents that fit your situation.

Standard document
SME Lawyers
Not tailored to your business
Tailored to your company, industry, and working methods
No control over your specific situation
Consultation with a lawyer and assessment of your risks
Possibly outdated or incomplete
Verification of current and practical provisions
No personal explanation
Explanation regarding the use of the document

A standard document seems cheap, until it doesn't fit your situation properly. That is why we provide custom legal solutions tailored to your business.

Custom solutions per industry and company

Every business operates differently and faces different legal risks. Therefore, we tailor the document to your industry, customers, agreements, and way of working.

Consultants, freelancers & advisors

Attention to scope, best efforts obligations, cancellation, payment, liability, and confidential information.

A legal document only has value if it suits your practice. That is why we look not only at the text, but also at how you use the document in your business.

Common mistakes with legal documents

A legal document often seems simple, but small errors can have major consequences later on. In practice, we see that entrepreneurs run the greatest risk when a document does not align well with their business, agreements, or way of working.

  • Using a standard document that does not suit the company
  • Forgot important agreements regarding payment, delivery, liability, or termination
  • Have a document generated without legal review
  • Continuing to use old documents while the company has changed
  • Not knowing how the document should be used correctly in practice

A legal document only prevents problems if it suits your situation. That is why we look not only at the text, but also at your company, agreements, and risks.

Why is a standard document often not enough?

Because a standard document does not take into account your industry, customers, risks, and specific agreements, important provisions may be missing or not align well with your practice.

Can I create a legal document myself using AI?

AI can assist in creating text, but does not independently assess whether the document is legally appropriate, complete, and usable for your business. Legal review therefore remains important.

When do I need to have my document checked?

Have your document checked if your business has changed, you have new customers or services, you have doubts about existing agreements, or the document has not been updated for a long time.

Will I also receive an explanation about the use of the document?

Yes. We explain how to use the document in practice, what to look out for, and which steps are important to prevent disputes afterwards.
