Custom choices

Which choices determine the content?

The content of your privacy policy depends on your specific processing activities. First, answer the questions below.

Choice or question Why this matters legally
Who are the parties involved? Customers, employees, and job applicants each require their own text; for employees, you typically use a separate internal privacy statement.
Which legal basis applies per processing? Consent, performance of the contract, a legal obligation, or a legitimate interest determine what you may and must disclose.
Do you engage processors? The use of, for example, accounting software or a cloud service requires data processing agreements and disclosure in the policy.
Are data transfers taking place outside the EEA? Transfers to countries outside the EEA require an appropriate level of protection, such as model contract clauses.
Do you process special or criminal data? Special data (health, race, religion) may only be collected under strict exceptions and require additional safeguards.
Clauses and provisions

What elements belong in a privacy policy?

A comprehensive privacy policy describes who is responsible, which data is processed, why, for how long, and with what safeguards. The components below form the basis for a GDPR-compliant document.

Provision Relevant to Legal point of attention
Identity of the controller Always Name, location, and contact details of your organization, so that stakeholders know who to contact.
Processing purposes and legal basis Always For each category of data, the purpose and the GDPR legal basis (consent, contract, statutory obligation, legitimate interest).
Categories of personal data Always Which data you process, for example name, address, email, payment details or special data.
Retention periods Always How long you retain data or the criteria for determining that.
Sharing with third parties and recipients When engaging third parties Which processors or partners receive data and on what basis, including transfers outside the EEA.
Rights of data subjects Always Right of access, correction, deletion, restriction, objection and data portability, and how to exercise them.
Security measures Always The technical and organizational measures with which you protect data.
Cookies and right to complain Regarding website or tracking Use of cookies and the right to lodge a complaint with the Dutch Data Protection Authority.
Use in practice

How do you use this document correctly?

A privacy policy is not a one-off document. Keep it up-to-date and visible.

Situation What should you do? Point of attention
Upon publication Place the policy in an easily findable location on your website and in your onboarding Data subjects must be able to access the processing operations in advance and without any barrier.
With new processing Update the policy before you start processing The duty to provide information applies at the moment you obtain data.
In case of a change of service provider Adjust the list of recipients and processors The policy must reflect your actual data flows.
Periodically Check goals, deadlines, and measures at least annually Outdated information renders the policy incorrect and therefore not GDPR compliant.
Common mistakes

Common mistakes

We frequently see these errors, and they lead to risks during inspections or complaints.

Wrong Consequence Better approach
Copy standard text from the internet Policy does not align with actual processing and offers a false sense of security Tailor the policy based on your actual data flows.
Do not specify legal basis per processing Processing is not demonstrably lawful Link each purpose to a concrete GDPR legal basis.
omit retention periods Lack of clarity and conflict with storage restriction Establish a time limit or clear criterion for each category.
Processors not in policy and without agreement Liability and risk of fines in the event of a data breach Enter into data processing agreements and name recipients in the policy.
Do not update policy Information becomes incorrect and no longer GDPR compliant Review and update the policy periodically.
Risk profile

What is your situation and what do you pay attention to?

The right policy depends on your type of organization and processing activities. Do you recognize your situation?

Risk profile Example Focus in the document
Webshop or online service You process customer and payment data and often use cookies Pay attention to cookie consent, security of payment details, and clear retention periods.
Employer You process data of employees and applicants Use a separate internal privacy statement and pay attention to proportionality, as with camera surveillance.
SaaS or software company You often act as a processor on behalf of your clients Align the policy with processor agreements and regulate transfers outside the EEA.
Care or special data You process health or other special data Ensure a statutory ground for exception and enhanced security and confidentiality.
Additional documents

When is this document not enough?

A privacy policy informs data subjects but does not regulate everything. In these situations, you need additional documents.

Situation Supplementary document Why
You engage an external party that processes data for you Data Processing Agreement With a processor, you contractually establish agreements regarding the security and use of data.
You share confidential information with a partner or employee Confidentiality Agreement To protect business-sensitive information outside the scope of the GDPR, use a confidentiality agreement.
You process data of your own staff Employment contract In the employment relationship, you record agreements regarding data and confidentiality in the employment contract.
Explanation of this document

Drafting a privacy policy, why?

Not every entrepreneur knows exactly what privacy policies are, when they are needed, and which risks they must cover. That is why we explain below what this document entails, what to look out for, and why tailored legal solutions are important.

What is a privacy policy?
A privacy policy is the internal or external policy document by which an organization sets out its approach to data protection. The external privacy policy—the public privacy statement—informs data subjects about the processing of their personal data and complies with the transparency requirements of Articles 13 and 14 of the GDPR. The internal privacy policy goes a step further: it sets out how the organization handles personal data internally, who is responsible for GDPR compliance, how data breaches are handled, how DPIAs are conducted, and how the processing register is maintained. A comprehensive privacy policy combines external communication with data subjects with internal data protection governance. Our lawyers draft a comprehensive privacy policy for your organization that correctly addresses both the external transparency obligations of the GDPR and the internal governance requirements.
What does the internal privacy policy regulate that the external privacy statement does not?
The internal privacy policy governs the organizational and procedural aspects of GDPR compliance that do not need to be made public but must be documented internally. The division of roles: who is the controller, is there a Data Protection Officer, and which employees have access to which personal data? The data breach procedure: how are data breaches identified, assessed, and reported internally to the Dutch Data Protection Authority (AP) and data subjects? The DPIA procedure: when is a Data Protection Impact Assessment conducted and by whom? The retention policy: an overview of all categories of personal data with the corresponding retention periods and deletion procedures. And the data processing agreement policy: the process for entering into and managing data processing agreements with suppliers. Our lawyers draft a comprehensive privacy policy that is fully compliant both externally and internally.
How does it work at MKBjuristen?
After a brief intake, our lawyers draft a privacy policy that correctly addresses the external transparency obligations of the GDPR and properly establishes the internal governance of data protection — aligned with your processing register, cookie statement, and processor agreements.
Are you unsure whether your document is legally correct? We would be happy to assess the sensible course of action: drafting, reviewing, or amending.

Why not use a standard document?

A standard document often seems like a quick solution, but usually does not fully align with your company, agreements, risks, and way of working. Our legal experts draft documents that fit your situation.

Standard document
SME Lawyers
Not tailored to your business
Tailored to your company, industry, and working methods
No control over your specific situation
Consultation with a lawyer and assessment of your risks
Possibly outdated or incomplete
Verification of current and practical provisions
No personal explanation

A legal document only has value if it suits your practice. That is why we look not only at the text, but also at how you use the document in your business.

Common mistakes with legal documents

A legal document often seems simple, but small errors can have major consequences later on. In practice, we see that entrepreneurs run the greatest risk when a document does not align well with their business, agreements, or way of working.

  • Using a standard document that does not suit the company
  • Forgot important agreements regarding payment, delivery, liability, or termination
  • Have a document generated without legal review
  • Continuing to use old documents while the company has changed
  • Not knowing how the document should be used correctly in practice

A legal document only prevents problems if it suits your situation. That is why we look not only at the text, but also at your company, agreements, and risks.

Why is a standard document often not enough?

Because a standard document does not take into account your industry, customers, risks, and specific agreements, important provisions may be missing or not align well with your practice.

Can I create a legal document myself using AI?

AI can assist in creating text, but does not independently assess whether the document is legally appropriate, complete, and usable for your business. Legal review therefore remains important.

When do I need to have my document checked?

Have your document checked if your business has changed, you have new customers or services, you have doubts about existing agreements, or the document has not been updated for a long time.

Will I also receive an explanation about the use of the document?

Yes. We explain how to use the document in practice, what to look out for, and which steps are important to prevent disputes afterwards.
